These terms govern your use of the Bernari website and your purchase of our products. By placing an order or using the site, you agree to be bound by them.
About Bernari
Bernari is a trading name of Artifacts of Silk Road PTY LTD (ABN 88 695 252 343), an Australian registered company based in Sydney, New South Wales. We supply commercial-grade aluminium pergolas and related outdoor living products to customers throughout Australia.
In these terms, "Bernari", "we", "us" and "our" refer to Artifacts of Silk Road PTY LTD trading as Bernari. "You" and "your" refer to the customer.
Eligibility
To order, you must be at least 18 years old, have the legal capacity to enter into a contract, and be ordering for a delivery address in Australia.
Products and descriptions
We make every reasonable effort to ensure product descriptions, images and specifications are accurate. Minor variations in finish, colour or batch may occur. If you require specific tolerances, contact us at info@bernari.com.au before ordering.
Pricing
All prices are in Australian dollars (AUD) and include GST where applicable. We reserve the right to change pricing without notice; changes do not affect orders already confirmed. In the event of a clear pricing error, we reserve the right to cancel the affected order and refund any payment in full.
Order acceptance
When you submit an order, you are making an offer to purchase on these terms. An order is confirmed only once payment is received and we have sent an order confirmation email. Until then, no binding contract exists.
We reserve the right to decline or cancel any order where the product is unavailable, there has been a pricing or description error, we cannot verify the order, or we reasonably consider the order fraudulent. Where we cancel before production commences, any payment is refunded in full.
Made-to-order products
All Bernari products are made to order to the size, finish and configuration specified on the order. Once production has commenced, the order cannot be cancelled, modified or refunded for change of mind. If you need to amend an order, contact info@bernari.com.au as soon as possible and we will tell you whether the order is still amendable.
Delivery
Delivery terms, timeframes and procedures are set out in our Shipping Policy, which forms part of these terms. Standard delivery is 6 to 10 weeks from order confirmation; custom sizing may extend this. We are not liable for delays caused by events outside our reasonable control, including carrier delays, weather, industrial action, supply chain disruption, fire, flood or acts of government.
Returns, refunds and consumer rights
Returns and refunds are governed by our Return and Refund Policy, which forms part of these terms. Nothing in these terms excludes, restricts or modifies any consumer guarantee or right you have under the Australian Consumer Law where the law does not permit such exclusion.
Installation
Our products are supplied for installation by the customer or your nominated trades. Bernari does not provide an installation service unless agreed in writing. You are responsible for safe installation in compliance with any product instructions and applicable building, planning or council requirements.
Liability
To the maximum extent permitted by law, and subject to the Australian Consumer Law, our total liability for any product or order is limited to the purchase price paid for that product. We are not liable for indirect or consequential loss, or for damage caused by incorrect installation, modification, misuse or failure to follow product instructions.
Intellectual property
All content on the Bernari website — including text, photographs, illustrations, drawings, logos, product names and design — is owned by Bernari or used under licence. You may not copy, reproduce or use it for commercial purposes without our written consent.
Privacy
Your personal information is handled in accordance with our Privacy Policy, which forms part of these terms.
Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
Severability and updates
If any part of these terms is found unenforceable, the remainder continues to apply. We may update these terms from time to time; the version that applies to your order is the version in force at the time your order is confirmed.
